This document sets out the legal terms and conditions (hereinafter, the “Terms”) of the raffle held by CARNICERIAS CAMPOVERDE SLU , with tax identification number B85768935 , (hereinafter, “CARNES CAMPOVERDE”) on the official Instagram and Facebook pages of @carnes.campoverde
FIRST. – Object of the Promotion
The object of this promotion is a contest between the participants to obtain the prizes detailed in the FIFTH clause of these Bases (the "Promotion").
The contest will consist of signing up on the event wall on the social networks of Carnes Campoverde to be able to participate in the draw for four gift cards valued at €50.
SECOND. – Territorial scope and duration of the Promotion
Territorial scope
The Promotion will be carried out throughout Spain via the official Facebook and Instagram pages of CARNES CAMPOVERDE . Hereinafter, the aforementioned official Facebook and Instagram pages of CARNES CAMPOVERDE will be referred to collectively as the “Official Pages”.
Promotion Duration
The Promotion will start on June 11, 2024 and will end on June 30, 2024 at 21:00 p.m.
THIRD. – Legitimation to participate in the Promotion
Those users, of legal age, residing anywhere in the world who are registered on the Official Pages and meet the requirements established in these Bases (the "Participants") may participate in the Promotion.
It is expressly stated that CARNES CAMPOVERDE reserves the right to verify the accuracy of the Participants' data, as well as the ages and identities of the winners before proceeding to deliver the prizes.
Employees of CARNES CAMPOVERDE , employees of companies with which CARNES CAMPOVERDE maintains a current commercial relationship, and their direct relatives up to the second degree of consanguinity or affinity will not be able to participate in the Promotion.
FOURTH.- Gratuity
Participation in the Promotion is completely free.
FIFTH. – Mechanics of the Promotion, Prize and communication to the Winner
The promotion will be carried out through the official pages of CARNES CAMPOVERDE.
In this sense, two winners will be designated on the official Instagram page and two winners on the official Facebook page.
In addition to the winners, CARNES CAMPOVERDE will designate one (1) reserve winner from each of the Official Pages (hereinafter, “Reserve Winner”). Therefore, if any of the prize winners does not meet the requirements established in these Terms and Conditions, the prize will be awarded to the Reserve Winner, provided that the latter meets the required conditions. Otherwise, the prize will be forfeited.
Winning users will be selected from among the users who comment on the posts/activities published on the Official Pages between June 11 , 2024 and June 30 , 2024 at 9:00 pm
The selection of the Winners will be made through a random drawing carried out by the marketing department of Carnes Campoverde.
The Winners must meet the requirements set forth in these Bases as well as have complied with the instructions indicated in the post associated with the draw, that is, like, follow the official accounts and mention a friend in the post.
The prize obtained by each winner will be a €50 gift card.
It is expressly stated that the Prize will not be exchangeable for money and will be subject, where appropriate, to the corresponding tax withholdings provided for in Law 35/2006, of November 28, regulating Personal Income Tax. Physics and the legislation that develops it.
Shipping costs will not be covered for the winner.
The names of the Winners will be published on the wall of the Official Page of CARNES CAMPOVERDE, and they must contact CARNES CAMPOVERDE through the contact option provided on the Instagram portal “Direct Message”, within one (1) calendar day from the day on which CARNES CAMPOVERDE has published the names of the Winners.
Once contacted with CARNES CAMPOVERDE , the winner must send by email to 'tienda@carnescampoverde.com' and also by private message of the Official Pages (i) a contact email, (ii) the full name and surname of the Winner, (iii) the postal address to which the Prize should be sent and, (iv) a scanned copy of the ID card or passport by which the age will be proven.
In accordance with the provisions of this clause, in the event that the Winner does not contact CAMPOVERDE MEATS does not comply with the requirements set forth in these Bases, he will lose the right to the Prize that will be assigned to the corresponding Reserve Winner. In consecuense, CAMPOVERDE MEATS will contact the Reserve Winner designated for these purposes, who will have one (1) calendar day to reply to the e-mail indicating the data and documents mentioned above. In the event that the designated Reserve Winner does not comply with the requirements and indications established in the Promotion, the Prize will be declared void.
The Winners may waive the Prize obtained, however, sending the email with the indicated documentation will be understood as acceptance of the Prize. Subject to the foregoing, if the Winner automatically waives the Prize it will pass to the Reserve Winner.
Once the prize has been accepted, the winner will be invited to post a photograph of the prize received on the wall of the corresponding Carnes Campoverde Official Page. Should CARNES CAMPOVERDE decide to publish said photograph (the “Photograph”), it must comply with the following requirements:
Do not violate any right, law or regulation, especially in relation to image rights and intellectual property.
Appear alone, that is, without companions or third parties. Nor can any brand, representative building, painting, sculpture or intellectual or industrial property right appear.
Appear dressed.
Be the author of the photograph.
SIXTH. - Personal data protection
The data collected will be processed by CARNES CAMPOVERDE in order to manage participation in this Promotion, public communication of the Winner (or, where applicable, Reserve Winner) and, where applicable, the delivery of the Prize, as well as to inform and send information about promotions, commercial prospecting and news from CARNES CAMPOVERDE.
In accordance with Articles 7 and 9 of EU Regulation 2016/679 of 27 April, concerning the protection of natural persons with regard to the processing of personal data and on the free movement of such data, by accepting these terms and conditions you explicitly consent to the processing described above, which is legitimized by your participation in this Promotion. Once the Promotion has ended, your data will be retained for the period necessary to comply with the applicable statutes of limitations for any potential data protection infringements. The collection of your personal data is essential for the proper execution of this Promotion. If you refuse to provide this data, you will not be able to participate, and CARNES CAMPOVERDE will be held harmless from any liability . Your data may be transferred to third parties for the proper conduct of this Promotion, as well as to companies affiliated with CARNES CAMPOVERDE. You may exercise your rights of access, rectification, erasure, objection, restriction of processing, and data portability at any time, as well as withdraw your consent to the processing of your data, by writing to CARNES CAMPOVERDE . In compliance with Article 80 of EU Regulation 2016/679, we inform you that you have the right to authorize the Spanish supervisory authority to exercise your data protection rights on your behalf, where appropriate.
Furthermore, in accordance with the provisions of Law 34/2002 on Information Society Services and Electronic Commerce, those who register grant the necessary prior authorization for CARNES CAMPOVERDE to send commercial and advertising information by email or other electronic channels. This authorization may be revoked at any time by sending written notification to the address indicated above.
By participating in the Promotion, each Participant declares and warrants that they are the owner of the profile on the Official Pages through which they participate in the Promotion. CARNES CAMPOVERDE accepts no responsibility arising from identity theft through its profiles on said Pages.
SEVENTH. – Assignment of rights to the Photograph and authorization to use the image of the Participant
In the event that, in accordance with the provisions of Clause FIVE of these Terms and Conditions, the Winner decides to send the Photograph to CARNES CAMPOVERDE for publication on the Official Website, it is understood that:
The Winner hereby assigns to CARNES CAMPOVERDE all rights of any kind (including, but not limited to, intellectual property rights, such as the rights of reproduction, transformation, distribution, public communication, and making available to the public, as well as image rights) to the Photograph, worldwide, exclusively, and for the entire term of protection of those rights, for its exploitation in any form (including, but not limited to, advertisements or promotional activities of CARNES CAMPOVERDE and this Promotion) and by any means (including, in general terms, the Carnes Campoverde website and social media and blogs associated with CARNES CAMPOVERDE , television, and print media). The foregoing assignment authorizes CARNES CAMPOVERDE to, in turn, assign the rights to the Photograph or to authorize its use by any third party, for any type of exploitation, under the same terms set forth in this paragraph. In any case, the Winner may revoke their consent for the future use of their image in new information or news at any time.
The Participant declares and warrants that they are the sole author of the Photograph and that they possess all necessary rights and/or authorizations of any kind to ensure the complete and effective transfer of rights. The Participant agrees to indemnify and hold harmless CARNES CAMPOVERDE from any and all damages (including third-party claims for plagiarism or any other reason) should this declaration and warranty prove to be false. Furthermore, the Participant acknowledges that the aforementioned transfer of rights to the Photograph is entirely free of charge. CARNES CAMPOVERDE accepts no responsibility for damages of any kind arising from the misuse, manipulation, or alteration of the Photograph by any third party once it has been published or disseminated by CARNES CAMPOVERDE . Participants who have submitted or seen their Photograph published on any of the Official Pages authorize CARNES CAMPOVERDE to use and exploit their image and name in advertisements or promotional activities of CARNES CAMPOVERDE and in this Promotion, which may be disseminated through any means, including those mentioned in section (i) of this clause.
EIGHTH. – Acceptance of the bases
To become a Participant, users must have expressly accepted the Terms and Conditions of this Promotion. A link will be provided on the CARNES CAMPOVERDE Official Pages wall through which users can access these Terms and Conditions.
Any statement to the contrary, that is, of total or partial non-acceptance of them, will imply the exclusion of the Participant and, as a consequence thereof, CARNES CAMPOVERDE will be released from the fulfillment of the obligation contracted with said Participant.
Failure to comply with any of the terms and conditions included in these Rules will result in the Participant's disqualification from the Promotion. In the event of any doubts or discrepancies in the interpretation of any of these Rules, or if there are any aspects not covered herein, CARNES CAMPOVERDE reserves the right to provide an interpretation in accordance with the spirit and purpose of the Promotion.
NINTH. – Modification of the Bases
CARNES CAMPOVERDE reserves the right to modify the Terms and Conditions of this Promotion in any way it deems appropriate during the Promotion period. Among other things, CARNES CAMPOVERDE may modify the Promotion period, as well as the number of prizes to be awarded. These modifications will be communicated to Participants through the Official Websites.
TENTH.- Causes of disqualification of a Promotion Participant
The Promotion governed by these Terms and Conditions aims to encourage and promote the participation of all consumers of CARNES CAMPOVERDE brand products , rewarding loyalty under equal conditions and with strict adherence to the general principle of good faith. For this reason, CARNES CAMPOVERDE will automatically and immediately exclude from the Promotion any Participant who violates the rules of good faith through inappropriate or improper conduct, or who breaches these Terms and Conditions in any way.
Likewise, any anomaly attributable to a Participant that prevents, alters or disrupts the normal development of the Promotion, that affects or harms any other Participant, – including but not limited to, falsifying participation data, compromising the security or reliability of the technical systems used for its development, or contravening these Terms and Conditions in any other way – will entitle CARNES CAMPOVERDE to unilaterally and immediately exclude said Participant and report the facts to the competent authorities.
In the event that any of the above irregularities, or any others, are detected after the actual delivery of the Prize, CARNES CAMPOVERDE reserves the right to exercise the relevant legal actions against its author or responsible party.
ELEVENTH. – Use of Official Pages
Any user of the Official Pages, whether or not they are a Participant in the Promotion, is aware and voluntarily and expressly accepts that the use of the Official Pages is, in all cases, under their sole and exclusive responsibility. When using the Official Pages, the user agrees not to engage in any conduct that could violate the law and/or these Terms and Conditions, or damage the image, interests, and rights of CARNES CAMPOVERDE or third parties.
Offensive comments, insults, threats, foul language, as well as degrading content or disparaging remarks about the products, services, brands, or staff of CARNES CAMPOVERDE or third parties, will not be permitted on the Official Pages. Any such comments posted on the Official Pages will be deleted, and the author will be immediately excluded from the relevant Promotion. Comments that explicitly or implicitly promote or facilitate advertising for CARNES CAMPOVERDE 's competitors will also be removed from the corresponding Official Page. CARNES CAMPOVERDE also reserves the right to remove any post from the Official Page that, in its opinion, does not conform to the desired content standards.
CARNES CAMPOVERDE takes reasonably adequate security measures to detect the presence of viruses. However, users should be aware that internet security measures are not infallible and, therefore, CARNES CAMPOVERDE cannot guarantee the absence of viruses, malware, worms, social engineering attacks from third parties (phishing, pharming, Trojans, etc.) or other elements that may cause alterations to the user's computer systems (software and hardware) or to their electronic documents and files stored on them.
CARNES CAMPOVERDE is exempt from any liability that may arise from events beyond its control, including but not limited to interference, omissions, interruptions, computer viruses, telephone malfunctions or disconnections in the operational functioning of the electronic system; as well as delays or blockages in the operational functioning of the electronic system caused by deficiencies or overload in telephone lines or on the Internet and damages caused by third parties.
CARNES CAMPOVERDE is authorized to temporarily suspend, without prior notice, access to the Official Pages for maintenance, repair, upgrade or improvement operations.
All content (including graphic design, source code, logos, text, graphics, illustrations, photographs, videos, trade names, trademarks or distinctive signs, and any other elements) appearing on the Official Pages, unless expressly stated otherwise, is the exclusive property of CARNES CAMPOVERDE or third parties. No intellectual or industrial property rights are granted to the user over the Official Pages or any of their constituent elements. The user is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding, or using in any way, by any means or procedure, any of these elements, except where legally permitted or authorized by the holder of the corresponding rights.
The user may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that it is not for the purpose of carrying out collective, commercial, or professional activities. The user must refrain from obtaining, or attempting to obtain, the content by means or procedures other than those made available to them or indicated for that purpose, or those commonly used on the Internet (provided that the latter do not entail a risk of damage to or disablement of the Official Pages). The user must at all times respect all intellectual and industrial property rights over the Site, owned by CARNES CAMPOVERDE or third parties.
TWELFTH. – Applicable law and jurisdiction
The Bases of this Promotion are governed by Spanish law.
Any controversy that may arise between CARNES CAMPOVERDE and the Participants arising, directly or indirectly, from the application of these Terms and Conditions, shall be subject to the applicable jurisdiction rules in accordance with current consumer and user regulations.
THIRTEENTH. – Base exclusions
The Official Pages do not sponsor, endorse or manage in any way the Promotion regulated by these Bases, nor are they directly or indirectly associated with them. By accepting these Rules, the Participants exonerate the Official Pages from any liability that may arise from the Promotion.
It is also expressly stated that the data requested from the Participants within the framework of the Promotion will be provided to CARNES CAMPOVERDE and, in no case, may it be understood that the recipient of said data is the Official Pages.
